A man who shot his partner’s ex-husband as they argued during child custody will not be charged as the shooting was ruled to be in self-defense.
39-year-old William ‘Kyle’ Carruth reportedly shot 54-year-old Chad Read during a custody dispute over the children of Read and his ex-wife Christina on November 5.
But a special grand jury found that Carruth will not be charged as the row occurred on his property and the shooting was in self-defense, said Attorney General Ken Paxton.
Carruth, the ex-husband of 72nd District Court Judge Ann-Marie Carruth, was not arrested for the incident, which his attorney described as a ‘justifiable homicide.’
Judge Carruth divorced him after the shooting.
Read’s new wife, Jennifer, managed to film the moment her husband was shot by Carruth and shared the disturbing video.
The footage shows Read demanding to see his 9-year-old son just outside Carruth’s home before he was shot and killed.
Jennifer Read will now launch a $50million wrongful death lawsuit in a civil court.
She took to Facebook and wrote: “Apparently in Texas it’s okay to bring a gun out to a verbal altercation and murder the ex. The ‘special’ grand jury was just for show.
“I don’t know of one other person who testified for Chad, besides me and his mom. They didn’t like being inundated with calls and did this to say they did it, but I guarantee they weren’t there for Chad Read.”
According to the Lubbock Avalanche-Journal, Lubbock County District Attorney’s Office had excused itself from the case because of Carruth’s relationship with the judge.
Investigators also turned their findings over to the Texas Attorney General’s Office.
“The presentation of the case included several eyewitnesses, family of Chad Read, and additional evidence that was not previously released to the public,” Paxton said.
“After several days of thorough inspection of the evidence, the Special Grand Jury concluded their investigation into the matter and deliberated on whether the evidence supported the filing of criminal charges against Kyle Carruth.”
“The Special Grand Jury voted today to not indict for any criminal charges against Kyle Carruth,” Paxton added.
