Amber Heard has demanded a new trial in her 68-page appeal against the verdict in Johnny Depp’s favor.
Earlier this year, the jury ruled Heard had to pay her ex-husband a total of $10.35 million after defaming Johnny Depp in her 2018 op-ed piece for the Washington Post.
Unhappy with the results of the defamation trial, Heard now filed a lengthy appeal in which her legal team argues that the trial was unfair because some ‘evidence’ – including Heard’s therapy noted – were excluded.
According to Heard’s attorneys, Virginia Judge Penney Azcarate “improperly prevented the jury from considering several instances in which Heard reported Depp’s abuse to a medical professional.”
The 68-page document notes: “If not reversed, the trial court’s exclusion of contemporaneous reports of domestic abuse to medical professionals will make it more difficult for other abuse victims to prove allegations of abuse, and likely deter them from coming forward.”
The filing adds: “That holding, if allowed to stand, undoubtedly will have a chilling effect on other women who wish to speak about abuse involving powerful men.”
Heard’s lawyers also argued that the case shouldn’t have even gone to trial because the United Kingdom High Court of Justice previously already ruled in Heard’s favor in a separate defamation suit overseas.
“This case also should never have gone to trial because another court had already concluded that Depp abused Heard on multiple occasions,” the appeal reads.
Despite the lengthy appeal, it is not very likely that Depp vs. Heard 2.0 will take place any time soon.
In order for Heard’s request for a new trial to be granted, a group of judges who will review the appeal would have to rule that the request is reasonable and appropriate.
