This is the third time Rylee McCollum’s family has tried to take action against the actor as previous attempts have been dismissed because of some errors in the filing process.

In the new version of their lawsuit, the soldier’s 23-year-old sister Roice McCollum shared some of the online abuse she received after the star messaged her on Instagram.

According to reports, Baldwin donated $5,000 to the family’s GoFundMe page months before he found out that he went to the January 6 Capitol riot, around eight months before Rylee died.

The actor took to the comments section of Roice’s photo on Instagram and wrote: “Are you the same woman that I sent the $ to for your sister’s husband who was killed during the Afghanistan exit?”

The 23-year-old had shared photos from when she went to the riot but none of which showed her face.

Baldwin then sent her private messages on Instagram, telling her to ‘own it.’

In their private conversation, the actor told her: “When I sent the $ for your late brother, out of real respect for his service to this country, I didn’t know you were a January 6th rioter.”

Roice replied telling Baldwin that she didn’t commit any crime and had already spoken with authorities.

“Protesting is perfectly legal in the country and I’ve already had my sit down with the FBI. Thanks, have a nice day!” she wrote.

The 64-year-old actor replied: “I don’t think so. Your activities resulted in the unlawful destruction of government property, the death of a law enforcement officer, an assault on the certification of the presidential election.

“I reposted your photo. Good luck.”

Baldwin said that it was ‘ironic’ that her brother had died fighting for the country and she was a rioter.

Since then, Roice was inundated with negative messages from internet users, some of who told her that her brother deserved to be killed.

She explained that even though she attended the riot, she was only a protester and did not partake in any rioting.

“He falsely accused Roice of destroying government property, causing the death of a law enforcement officer,” the lawsuit said.
