Alec Baldwin will reportedly not be charged with shooting Rust director Joel Souza.
The embattled Hollywood actor fatally shot cinematographer Halyna Hutchins while injuring Rust director Joel Souza on the set of the low-budget western movie in Santa Fe in late 2021.
While the 64-year-old father-of-seven was last week charged with involuntary manslaughter over the death of Hutchins, he will not face any charges for shooting Souza who was hospitalized after the incident on the Rust set.
According to the prosecution, battery normally requires intention and there is no unintentional battery charge that Baldwin could face over the shooting of Souza.
Since it is believed that the actor had no intention whatsoever on firing the bullet, Baldwin was not charged with battery.
Calling the involuntary manslaughter charge a “terrible miscarriage of justice,” Baldwin has since vowed to fight the charge.
Facing an involuntary manslaughter charge is also Rust armorer Hannah Gutierrez-Reed who allegedly handed a loaded gun to Baldwin before he practiced pulling the weapon out of his holster.
“We’ve done this for two weeks and we’ve done it the right way every day. Right before you shoot. I went to lunch,” Baldwin previously told the police.
“She disarmed me – Hannah – she always handled the gun. I come back, they hand me the revolver – Hannah – they arm me. You’re assuming it’s a cold gun. I put the gag in the shot.
“I take the gun out, as it clears – I turn and cock the gun and the gun goes off. It’s supposed to be a cold gun. Bang, she [Hutchins] hits the ground. [Joel Souza] goes down, screaming going ‘Jesus Christ!’”
Slapping back at the involuntary manslaughter charge, for which Baldwin could be imprisoned for 18 months, the actor’s attorney said:
“This decision distorts Halyna Hutchins’ tragic death and represents a terrible miscarriage of justice. Mr. Baldwin had no reason to believe there was a live bullet in the gun — or anywhere on the movie set.”
