A man is going viral after winning a case of unfair dismissal for taking 808 sick leaves.
The shocking decision made headlines, putting plenty of people, including his own organization in sheer disbelief. According to media reports, Vic Rumbold worked in the upscale firm, Jaguar Land Rover. He maintained his position in the car manufacturing plant for 20 years. However, due to a certain health condition, he had no choice but to take leaves.
But once he did, it just didn’t stop. And in total, they rounded out to be an amount that went above 800.
Here are more details on the bizarre yet fascinating case that’s keeping viewers glued to their screen.
Meet Vic Rumbold- a man that’s getting a great claim to fame
Who doesn’t love taking an off from work? And in some cases, there are generally days where you can’t really help yourself, even if you wanted to. Does that pave way for unfair dismissal?
Vic Rumbold is a loyal employee from West Midlands. He works at one of the world’s most famous automobile manufacturing plants. With a working history of 20 years with the organization, you’d expect them to praise him for obvious reasons.
However, that’s just the opposite in this case. And it’s all thanks to his poor track record when it comes to attendance. Media reports explain how the company fired him for taking 808 sick leaves. While they never issued him any warning, he had no choice but to leave.
But if you think that was the end of him, you might want to think again.
Unfair dismissal case enters the courts
Vic didn’t think it was right for his organization to fire without any warning. Also, the fact that he took an off for sick reasons and not personal gains is another point worth considering.
And that’s when he decided to file his case in the courts for unfair dismissal. Needless to say, he surely made the right decision because, in the end, it all proved right in his favor.
Certainly, no one expected him to be rewarded for missing hundreds of days from work. And that’s especially when his 808 shifts total to around 100,000 British Pounds. How did the tribunal reach such a massively appalling decision in the first place?
Well, reports explain that they heard about his 405 missed shifts which took place in Rumbold’s last 4 years of working tenure. However, in the company’s defense, launch manager Jon Carter spoke upon how Rumbold’s absence cost the company 100,000 pounds. In addition, he made claims on how he lacked enthusiasm when it came to returning back to his duties.
“Worst absence record that you’ll ever see”
Carter mentioned to the tribunal how Rumbold had the worst absence record that anyone could possibly hold. In the same way, he talked about how he never completed a year with a full attendance record.
On the grounds of conduct as well as capability, the organization fired him in December 2018. However, the Tribunal judge disagreed with the organization’s ruling. He felt that the company didn’t apply the proper protocols related to Attendance Management Procedures. Hence, they were wrong with the unfair dismissal to start with.
Also, they never issued any warnings or offered any counseling sessions that could signal room for improvement.
Rumbold suffered from serious health concerns after doctors diagnosed him with avascular necrosis disease in 2017. And that is what ultimately led to his giant leave of absence from his duties. With a job that demands physical movements, it was impossible for him to continue without a leave.
