A 3-year-old girl tragically died after she was accidentally shot by a 5-year-old boy.
The devastating incident occurred on August 13 at nearly 4 am inside a home in Minnesota, said Cass County Sheriff Tom Burch in a press release.
Police responded to a 911 call about the incident, which Sheriff Burch called ‘accidental.’ It is not clear how the children had access to the weapon.
The Sheriff’s Office took to Facebook and wrote: “Cass County Sheriff Tom Burch reports that on August 13th 2021 at 3:54 AM, the Cass County Sheriff’s Office received a report of an accidental shooting at a residence in Bena MN.
“Deputies responded and learned that a juvenile female, age 3, had been shot by accidental gunfire by a juvenile male, age 5, in the household.
“The victim was being transported to the Deer River Hospital by family members and intercepted by the Deer River Ambulance. Lifesaving efforts were attempted. The juvenile female was pronounced deceased at the Deer River Hospital.”
The post added: “An autopsy is pending with the Midwest Medical Examiner’s Office and the investigation continues.
“Assisting at the scene was the Leech Lake Tribal Police Department.”
It is currently not clear how the 5-year-old boy obtained the gun, the relationship between the two children, and if any adults were arrested.
Under Minnesota law, “Children under the age of 14 years of age are incapable of committing crime.”
According to Giffords Law Center, Minnesota Child Access Prevention laws states: “Minnesota prohibits any person from negligently storing or leaving a loaded firearm in a location where the person knows, or reasonably should know, that a child under age 18 is likely to gain access to the firearm, unless reasonable action is taken to secure the firearm against access by the child.
“This prohibition does not apply if the child obtained access as a result of any unlawful entry.”
