A mother from South Carolina was awarded $10 million from Walmart after she underwent three amputations because she stepped on a nail inside the store.
It was in 2015 when April Jones was walking through an aisle of a Walmart on Beltline Drive when she suddenly felt a sharp pain. She then saw a rusty nail had pierced through her shoe and foot.
Jones suffered an infection and endured three separate amputations that resulted in her losing her right leg.
For six years, Jones had been bound to her wheelchair as the incident ‘significantly interrupted’ her daily life, a statement from Anastopoulo Law Firm said.
According to the law company’s attorneys, Walmart’s policy mandates staff to perform regular sweeps inside the store.
“The weakness of Walmart’s case, among other things, was their failure to produce a video that they claim showed their conforming behavior to a company policy calling for employees to perform regular safety sweeps. No such evidence was presented for the duration of the five-day-long trial,” they said in a statement.
Trial counsel Roy T. Willey IV said: “The jury sent a message to Walmart that if you come into Florence County and injure one of their own, they will make sure that person is taken care of. We are forever grateful.”
The verdict comes after a woman in Florida received $2 million over injuries she sustained at another Walmart branch. According to reports, she slipped and fell on milk leaking from a malfunctioning dairy cooker.
Judith Demeritt sustained permanent injuries to her arm and neck after the fall.
Another woman named Lesleigh Nurse was awarded $2.1 million after Walmart falsely accused her of stealing groceries even though she paid for them.
